Directive Principles of State Policy Question and Answer:

The Directive Principles of State Policy are enumerated in Part IV of the Constitution from Articles 36 to 51. The Constitution does not contain any classification of Directive Principles. However, on the basis of their content and direction, they can be classified into three broad categories, viz, socialistic, Gandhian, and liberal-intellectual. These principles are not enforceable by the courts. But they are fundamental for the governance of the country. They aim at promoting the Social Welfare of the people. Dr. B.R. Ambedkar described these principles as ‘novel features’ of the Indian Constitution.

  • Art-37 of the Indian Constitution states the application of the Directive Principles.
  • Art-38: The State shall strive to promote the welfare of the people by securing and protecting a social order by ensuring social, economic, and political justice and by minimizing inequalities in income, status, facilities, and opportunities
  • Art-39: The State shall, in particular, direct its policies towards securing:
    • Right to an adequate means of livelihood to all the citizens.
    • The ownership and control of material resources shall be organized in a manner to serve the common good.
    • The State shall avoid the concentration of wealth in a few hands.
    • Equal pay for equal work for both men and women.
    • The protection of the strength and health of the workers.
    • Childhood and youth shall not be exploited.
  • Art-41: To secure the right to work, to education, and to public assistance in cases of unemployment, old age, sickness, and disability.
  • Art-42: The State shall make provisions for securing just and humane conditions of work and for maternity relief.
  • Art-43: The State shall endeavor to secure to all workers a living wage and a decent standard of life.
  • Art-43A: The State shall take steps to secure the participation of workers in the management of industries.
  • Art-47: To raise the level of nutrition and the standard of living of people and to improve public health.

It was derived from the Constitution of the USA. It was drawn on the model of the Constitution of Ireland.
Even the Government cannot take away or abridge these rights. These are mere instructions to the Government.
These are enforceable by a court of law. These are not enforceable in any court.
These have legal sanctions. These have moral and political sanctions.
These rights strengthen political democracy in the country. The implementation of these principles ensures social and economic democracy.
